Angry Help me get my skimmer back!!

Weird story, here it goes

I sold a skimmer.
I shipped the skimmer via Fedex Ground to buyer in GA.
The skimmer was delivered to someone in FL
Fedex shipping record shows that I entered the FL address.
Ok, my fault.
I paid Fedex to go to the incorrect FL address and try to get my item back.
The recipient acknowledges receiving the item.
The receipient refused to give the item back to Fedex driver.
Fedex says they can do no more.

So, I have the address and first name of the person who has the item.

Located in Hialeah, FL, down by Miami.

I am sending a certified letter today to this address to request that they call me and arrange getting the item back.

I assume the person will never call me

What next?

YIKES! Not sure what you can do next! Wonder if the people that got it even know it was. Have you tried to google them to see if you could pull a phone number and just try to call them?

Can you contact the law and see if there is anything that can be done? I would think that is theft. If it was not addressed in the name of the person that has it I believe it is illegal for them to even open it.

to keep on topic. im sure a few nice knocks on their front door would be plenty of reason for them to give back the skimmer.

what kind of skimmer was it? if it was a deltec. lets get in the car lol

My parents live down the street from hialeah. We can setup a base and command center.

I sold something and shipped it to canada and had the same issue. It went to the wrong person and the guy wouldn't return it. So UPS just kept going to his house daily until the guy got fed up.

812.014 Theft.--

(1) A person commits theft if he or she knowingly obtains or uses, or endeavors to obtain or to use, the property of another with intent to, either temporarily or permanently:

(a) Deprive the other person of a right to the property or a benefit from the property.

(b) Appropriate the property to his or her own use or to the use of any person not entitled to the use of the property.

c) It is grand theft of the third degree and a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084, if the property stolen is:

1. Valued at $300 or more, but less than $5,000.

2. Valued at $5,000 or more, but less than $10,000.

3. Valued at $10,000 or more, but less than $20,000.

(e) Except as provided in paragraph (d), if the property stolen is valued at $100 or more, but less than $300, the offender commits petit theft of the first degree, punishable as a misdemeanor of the first degree, as provided in s. 775.082 or s. 775.083.

3)(a) Theft of any property not specified in subsection (2) is petit theft of the second degree and a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083, and as provided in subsection (5), as applicable.

(b) A person who commits petit theft and who has previously been convicted of any theft commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.

(c) A person who commits petit theft and who has previously been convicted two or more times of any theft commits a felony of the third degree, punishable as provided in s. 775.082 or s. 775.083.

I'd call the PD down there and see if they will help but you need to know the person that accepted the package and if its the same person thats keeping it from you.

Then again.... if you were a real bad person you could google them find out who they are and then call the IRS and tell them that you cheated on your taxes the past few years and want to make thing right set and appointment and of course they will not show. I'm sure the IRS will want to know more.

This is only a joke and not meant to be taken as a serious method of solving you problem.

ok let's see what I can answer:

I have googled what I could, found nothing as far as a phone # or more info.

The skimmer is an old EuroReef, not worth much.

I am not the confrontational type any more, or I would drive down to say hello

you can sue the person but thats about it you shipped it to him. mistakenly or not. you sent somthing to some one. double check your shipping next time.

It just sucks, your out the money and the skimmer. Anyways its going to be tuff to get that sucker back, they probably already sold it on ebay or something.

There is something called, I believe, called unsolicited merchandise laws. Do some research on the internets, and you will see you are probably out a skimmer unless brute force or coercion is your friend.
Truthfully, if the people are being so uncooperative, you are liable to find yourself in a bad position - ie, - staring down the barrel of a gun or a baseball bat. Not sure if a skimmer is worth the time and effort, especially when it was yourr own mistake.

That only applies when the package is addressed to you. If it has another name on it, you cannot open it up without breaking the law. This is with USPS. UPS/Fedex might be a little different.
