Something like this just happened in my area (Sacramento). Some guy was sitting in his house watching tv. He heard something outside, grabbed his gun and went to investigate. He found 3 men breaking into his car and he unloaded on them. He managed to hit one of the thieves in the process. HE was arrested for using deadly force but got off due to public outcry, and the thieves are awaiting court dates. He was told by the police that even though the men were breaking into his car, he was not allowed to use a gun in this situation since the car was outside of his house.

Yeah thats real fair. What do they want him to do watch as his car gets destroyed? This is so messed up. OR should he go out there and try and fight 3 guys hand to hand. Why have we given away our right to protect our property.


I would really like to know how all of YOU feel about this. Basically I thnik the concensus is that if you enage a suspect that is breaking into your vehicle while outside your home you will be at fault. Having said that what do YOu all think of it? Do you feel like you should be allowed to wound them like in the leg so they can't run, I am curious to know how all of you feel. Please do post ..

I'd whoop their butts with a golf club or baseball bat since i don't own a gun. If someone wants to screw with my stuff they are going to pay. I don't agree with the law in this case, as response time is usually to slow to catch them in the act. However having a CHP officer living across the street is a good thing because as soon as the fist guy starts screaming in pain my neighbor would be outside in a heartbeat, with his gun!

The scary thing is that they can have guns. If they are willing to pull a stunt like that you never know. Thats what is so troubling. I mean if you don't have the element of suprise then the law is actually asking you to place yourself in danger. Hell I bet a crafty lawer can switch things up so that they can say that you are wrong for defending your stuff since you did not give the criminals fair warning. I mean who knows right. If your going out there with a bat then you can get killed. I say all bets are off, why should you have to reason with them they are doing a crime lol. I am not a neigotiator.I think that's why we have so much crime, I mean the law is too weak. Even if you catch said theif they are out way too quick. No big loss for them.

I had to sped my time and money fixing my window and account for the loss of the stolen goods.

How about this. Can you call the cops then go out there and point the gun at them and tell them to get down on the ground and wait for the cops to show up?

If you go outside with a gun and tell them to freeze, and they approach you instead of running, wouldnt you reasonably fear for your life? This should be enough cause to use deadly force. If they run then thats another story. So what about these texas laws...... Im curious on what I can get away with now.... :: Chambers round ::
