Unfortunately, I don't think there is much you can do, as I don't believe that you automatically get copyrights if you have pics up on the web.

However, I think an email and some slander may be in order...

Wow. It sure looks like your shot. As a dumb lawyer, and just out of morbid curiosity, what are your damages? Any profits he made from the photo would be recoverable but probably wouldn't be too much. You might get some punitive damages, but again, probably not too much. Might want to put some feedback on EBay and let it go.

BTW: Do you have a copyright notice on your site and photos. Good idea if you really want to protect your intellectual property, especially on the web. E-mail me if you wish with any questions.
