Beware of flyin2jz (long post)

I may be the most gullible RC'er, you be the judge.

This saga goes back to 11/04. I was selling lighting stuff

flyin2jz (Kevin Hornsby) contacted me about a trade for frags. I sent a dual 400 watt PFO HQI ballast and 6 Radium bulbs, 3 new, 3 used the end of 11/04. Kevin sent me $30 to help cover shipping. I had been having some tank problems and about 1/05 it looked like we would complete the deal and he would send me some frags. Then tragedy struck him:

I gave it a couple months, end of 2/05. He said he got 30 new pieces and would send me 25-30 frags. I waited, nothing. Finally 5/05 I contacted him and let him know my tank was packed with frags and maybe we could settle on a monetary amount, which we did at $250, which seems more than fair considering what I had sent. He never sent the cash. Then I see him trying to sell his tank. I asked him to pull my stuff off and send it back which he never did http://archive.reefcentral.com/forum...hreadid=610774
Over the ensuing months I contacted him without much luck. I ended up filing in small claims and contacted the local police. The police did go talk to him and he said he would pay. He finally said he ran into some financial difficulties but intended to pay and would cover my fees. I told him if he would at least make some sort of effort to pay I would dismiss the small claims action. He sent me $50 twice at the end of 7/05, early 8/05. Hadn't heard from him since. I finally see him back last month on a thread, inquiring about corals he had sent to another reefer and that he was getting started again. I PM'ed him and he told me he would pay the following Friday (which is the line he always uses), nothing sent. PM him again, says he will pay me Friday, intends to pay, wouldn't be responding to me if he was going stiff me. That was this past Friday, nothing, no contact. PM'ed him yesterday, he got the PM, hasn't responded.
What really gets me is that I have been patient, I have not left him negative feedback on the boards at his request (until now), I was able to get the search function to work a week or so ago and he bought himself a used tank http://archive.reefcentral.com/forum...hreadid=750663
I doubt he'll ever pay me now but just wanted to let everyone know what kind of saga you may be in for.

I've always been wearing of trades unless they are in person. You can never be sure that the other guy is going to hold up his end of the bargain.

yep im the jerk. I told ben i would send him. the frags that we had talked about but all of the sudden he didnt want them. SO now he wanted money for the ballast which we hadnt talked about. SO now hes throwing a figure in the air which we never discussed. He knows i was going thru some problems but his ballast payment was more important. I told you ben that we would work this out but i guess that wasnt good enough. Sorry for the delay but i guess you really dont care. Kevin

we agreed on a price after you said you didnt want any frags. I will pay you i already told you that. I have never been trying to duck you. I know alot of people on this forum and havent had any problems before. thanx for your patience Kevin

It's been over a year! I would def. call that ducking! Then you go and buy a new tank before you pay him back!

He's WAY more patient than I ever would have been. You would have been in court over 10months ago if it was me!

wow, I'd say you definatly put him off again and again. sorry,but your very wrong and not only should you send him his cash you should offer a humble apology! he was WAY more patient and understanding than most. you having personal probs has nothing to do with a business deal. we ALL have problems. do the right thing.

Wow... congrats to rxx2 for an incredibly well documented complaint.


I see little room for excuses. Especially when what you sold him has already been resold! He keeps making a big deal about you changing your mind on the frags... what do you expect after 6 months???

How long does RC keep posts on the site? You might request they archive those posts for you in case you end up going to small claims court.

Good luck getting it worked out.

sent ben the money tonight. he is a really good guy. i know he has been more than patient with the entire ordeal. The reasons for the non payment he knows and understood what was up and didnt blab the reason on this forum which i appreciate very much sorry for the flaming i just hate being attacked by people that dont know my situation. Please don't tell me he sent you $25!?! Thats not what you mean by half is it? He already sent $100, you agreed on $250, half being $125, thus only needing another $25. You mean half of what was left to pay... right?

Either way, I would be infuriated!

You have been MORE than patient.

I am a very forgiving and understanding person, and I have let people pay me for things over the course of a year when they are having troubles... but if they had sold my stuff AND bought a new tank during that time, my understanding would be GONE!

Kevin, you need to pay this poor guy in full. MAKE it a priority! In my opinion, paying off debt comes before eating out, buying corals, or paying for cable TV. If you have cable, cancel it. If you have a cell phone that you pay for... get rid of it. This is ridiculous.

atleast flynjz is trying. Although i hate to be in your situation something is better than nothing. A year is a long time but i been on the short end of many deals and got nothing out of it.
