Sump level with tank
If I place my sump level with my tank would it still work properly?

it would have to be a little higher or lower or you would need two pumps.

the level of water in the sump and the level in the overflow of the tank wouldn't equalize from gravity if they where side by side?

I've seen sumps plumbed in series which is similar to what you want to do.
A conventional HOB overflow typically doesn't work great in this application because youd have to keep the water level too low in the sump. The best way to plumb this is with bulkheads connected with flex tubing so the glass isn't stressed. Also the drain lines need to be up sized. A horizontal drain just doesn't have the capacity of a drain that drops and creates suction.
