2nd hand smoke, child abuse?

I wanted to find out what everyone thinks about parents smoking in a car with their kids in it.

My perspective:

I have seen infants in car seats with smoking parents and I think that this is insane. Everyone knows now a days that smoking is harmful, and that exposure to it may lead to health problems down the line. If a parent knowingly exposes their child to something like 2nd hand smoke then shouldn't they be held accountable?

The only flaw I see in this argument:

Parents knowingly take their kids to an unhealthy place like Mc Donalds for lunch/dinner daily but should this be considered child abuse?

PS:
My parents did smoke in the car and stopped the minute the doctor told them about the risks of second hand smoke. This was in the early 90's

I'll try and post a poll, and if this post is not acceptable then sorry and please take it down.
