Did he really issue a refund or is this just an attempt to hope you won't ever look at this thread again and everyone can think he is an "okay-seller" ?

The refund is currently pending clearance of your account.When that happens,I will post here and retract all my nastiness-well most of it.

IF the controller ever does arrive at my door,I will return that to you WITH a tracking number..of that you should not worry.

I checked out that thread, I have been looking for a controller and didn't think it was a bad deal, but I have decided on the Reef Keeper 2... Glad to hear you might be getting your money back GinaSofia, next time take some precautions before buying stuff on here.

It was really,really smart(and corrupt) how you went to your bank and told them that the refund was "unauthorized" therefore canceling the refund.

Rest assured Paypal will be turning over all of YOUR information to investigators upon receiving the subpoena.

Way to go!Be a good wife to Bubba;)

yep,he went to his bank and put a "stop payment" on the refund transaction stating that it was unauthorized(although he initiated it himself..go figure!).

He wrote me a PM last night saying how sorry he was and that the refunds had accidentally been processed via the wrong account.

He also promised that I would have a complete refund by tonight,I'm holding my breath(yeah,right).

The internet fraud investigators have already contacted Paypal(amazingly PP is being VERY helpful)and will be contacting his local police shortly.

Honestly, I dont think you can prosecute him with mail fruad.
He obviously never sent anything in the mail so he didnt defruad the Mail service.
This may be bank fruad though from what I have read.
He stopped payment through his bank which, its not a crime in its self.
Theft is a crime and he did use Paypal to to rob you.
I am guessing that any prosecution as fruad would have to be done via paypal and not you.
Technicaly they are the ones that he defruaded.
He just out right stole from you.

What you should have done from the start was file a claim with paypal for goods not recieved. There would have been a short investigation, and he would have been forced to refund your money or paypal would have taken it from his bank account with the banks cooporation, or directly out of his paypal account.

If you had chosen the buyer satisfaction option when you paid for the item you wouldnt be going through this right now either.
It would have made it much easier for paypal to prosecute him as well. Since you would not have been involved with it after they refunded your money through the buyer protection.

ALWAYS PURCHASE BUYERS PROTECTION PEOLPLE.
It realy does work, and all you have to do is file the claim.
It is up the the seller to proove he/she sent it. They must provide a Tracking number of the shipment, if thet have no tacking number than its case closed.

If you do manage to prosecute him for theft it would go to small claims court since its less than $1000.00 and he would be ordered to pay restitution of which I am sure he would defualt on. Then he would probably only get probation, and ordered to repay the amount all over again, and keep defaulting on until he gets sent to do the time they have on the shelf for him from the previous aprearences.


I wish you luck with this but its going to be very long and drawn out from here on out for you I bet.

First of all it's "Internet Fraud" and as such it is a Federal crime.

2nd: there is no Buyer Protection as this was not an auction but he was Paypal verified so they do have all of his information.

3rd:PayPal is cooperating fully with investigators since they could not pull the money out his account AFTER they found in my favor and AFTER he initiated a refund because he CLOSED the account.

Paypal has a record of him pulling this same stunt and they are prosecuting on their end as well.

BTW..I'm still holding my breath.:rolleyes:

Wire fraud is just as serious as mail fraud. ;)

To all interested-

In an effort to help GinaSofia, I contacted my Federal source, who
has issued a warrant for this "clown". Now if he is stopped for
jaywalking, speeding, etc. He will be busted! Dennis

not really just a bunch of empty promises on the "seller's" behalf.

He did PM me that he called his local police department and was told that this was a small claims situation, and that had he had nothing to worry about.I double-dared him to go down there with his ID to see if he in fact has a warrant for his arrest or not ;)

*Paypal was able to recover $72.72,through no help from him,of course*
