Looks like a cap snail, aka Stomatella varia.

I guess it doesnt matter if he is good or bad because I followed my rule of "when it doubt, take it out"

They're good, but readily available as hitchhikers and they reproduce in our tanks (better in tanks without shrimp).

Does it have a hard shell on top?

Thats the thing...the shell isnt really that hard...its almost soft or at least "pliable"

The shell is quite hard, yet small.
